Terms of Service

1. Agreement

These Terms of Service (the “Terms”) form a binding agreement between you and Digipet (“Digipet”, “we”, “us”, or “our”). They govern your use of the Digipet mobile application and any related services we offer (together, the “App”). By creating an account, signing in, or otherwise using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You may use the App only if you are at least 18 years old, or at least the age of majority where you live, and able to enter into a binding contract. The App is not directed at children under 13. By using the App, you represent that you meet these requirements.

3. Your account

• You are responsible for keeping your login credentials secret and for everything that happens under your account.
• You agree to provide accurate information when you sign up and to keep it up to date.
• You agree not to share your account, sell access to it, or use someone else’s account without their permission.
• If you suspect unauthorised use of your account, tell us immediately at DigiPetSG@gmail.com.
• You may sign in using a third-party identity provider (currently Google or Apple). When you do, your use of that provider is also governed by that provider’s own terms and privacy policy. We do not control, and are not responsible for, those services.

4. Your content

The App lets you store information and photos about your pet (your “Content”). You keep ownership of your Content. You grant us a worldwide, royalty-free, non-exclusive licence to host, process, transmit, and display your Content solely so that we can operate the App for you (for example, syncing your records across your devices and generating PDF exports you request). The licence ends when you delete the Content, except that we may retain backup copies for a reasonable period and may keep information we are required to keep by law.

You represent that you have the right to upload your Content and that it does not infringe anyone’s rights. You agree not to upload anything unlawful, defamatory, infringing, misleading, or harmful.

Some Content stays on your device only. Photos you attach to a vaccination record, a trip’s hero shot, and per-checklist documents (for example, an export licence) are saved to your phone’s sandbox and are not uploaded to our servers. You are responsible for backing them up via the in-app Backup & restore feature before changing devices. Bundles produced by that feature are unencrypted JSON files; treat them like any other private document.

5. How you may use the App

You agree not to:

• use the App for any illegal purpose, or in a way that violates these Terms or any applicable law;
• attempt to disrupt, overload, reverse-engineer, decompile, or circumvent any security or rate-limiting measure;
• scrape, copy, or otherwise extract data from the App except for your own personal records;
• impersonate any person or misrepresent your relationship with anyone;
• use the App to harass, threaten, or harm any person or animal;
• use the App to provide veterinary or medical services to other people’s pets in a professional capacity (the App is for personal record-keeping, not clinical practice).

6. Not veterinary advice — health and safety disclaimer

The App is an information and record-keeping tool only. It is not, and is not intended to be, a substitute for professional veterinary advice, diagnosis, treatment, medication management, behavioural assessment, or emergency care. The App does not:

• provide veterinary, medical, pharmaceutical, nutritional, or behavioural advice;
• diagnose any condition, disease, or injury;
• recommend, prescribe, dose, or schedule any medication, vaccine, supplement, food, or treatment;
• verify the accuracy of any vaccination, medication, dosage, allergy, condition, weight, vet name, microchip number, or other record you enter;
• guarantee that any reminder, notification, alert, or scheduled message will be created, delivered, delivered on time, or seen by you (delivery depends on your device, operating system, network, and notification permissions, all of which are outside our control); or
• guarantee that any information shown about places, vets, breeds, or other third-party content is accurate, current, or suitable for your situation.

You are solely responsible for the accuracy of everything you enter, for verifying it with a licensed veterinarian where appropriate, and for every decision and action you take in respect of your pet, yourself, your household, or any third party. Always consult a licensed veterinarian for any concern about your pet’s health, safety, diet, behaviour, or welfare, and seek emergency veterinary care when warranted. Do not rely on the App in an emergency.

7. Third-party content and links

The App may include information about places, vets, products, services, or other content provided by third parties (including a curated list of pet-friendly venues in Singapore). Such content is provided for convenience only. We do not endorse it, do not control it, and do not warrant that it is accurate, current, lawful, safe, or appropriate. Your dealings with any third party are between you and that third party.

8. Fees

The App is currently free to use. We may introduce paid features in the future. If we do, we will tell you what they cost and how to subscribe before you are charged.

9. Intellectual property

The App, its name, logos, design, code, content (other than your Content), and all related intellectual-property rights belong to Digipet or our licensors and are protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose. Nothing in these Terms transfers ownership of any of our intellectual property to you.

10. Suspension and termination

You may stop using the App at any time. To close your account and delete your personal data, you can either use the in-app control (Profile → Close Account) or contact us at DigiPetSG@gmail.com. We may suspend, restrict, or terminate your access at any time, with or without notice, if we reasonably believe you have breached these Terms, exposed us or other users to legal or security risk, or if we cease to operate the App. Sections of these Terms that by their nature should survive termination — including sections 4 (Content licence to operate), 6 (Disclaimers), 11 (Warranty disclaimer), 12 (Limitation of liability), 13 (Indemnity), and 16 (Governing law) — survive termination.

11. Warranty disclaimer

To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, accuracy, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the App will be uninterrupted, error-free, secure, free of harmful components, or that any data will be preserved without loss.

12. Limitation of liability

To the maximum extent permitted by law, in no event shall Digipet, its founders, employees, contractors, agents, suppliers, or licensors be liable to you or to any third party for any:

• indirect, incidental, special, exemplary, punitive, or consequential loss or damage;
• loss of profits, revenue, savings, business, opportunity, reputation, or goodwill;
• loss, corruption, or unavailability of data;
• cost of substitute goods or services;
• injury, illness, suffering, or death of any animal — including your pet, any third party’s pet, or any other animal;
• injury or harm to any person, including yourself, members of your household, or any third party (for example, harm caused by an animal whose records are kept in the App);
• damage to property of any kind;

arising out of or in connection with the App, the service, any information you obtained from or entered into the App, any reminder or notification (or absence of one), or these Terms, regardless of the legal theory (contract, tort, negligence, strict liability, statute, equity, or otherwise) and regardless of whether we have been advised of the possibility of such loss or damage.

Without limiting the foregoing, our total aggregate liability to you for all claims arising out of or relating to these Terms or the App, in any twelve (12) month period, is limited to the greater of (i) the total amount you paid us in that period and (ii) Singapore Dollars Fifty (S$50).

Some jurisdictions do not allow some of these exclusions or limitations. In those places, our liability is limited to the minimum extent permitted by law and nothing in these Terms is intended to exclude liability that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify, defend, and hold harmless Digipet and its founders, employees, contractors, agents, suppliers, and licensors from and against any and all claims, demands, actions, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• your use of, or inability to use, the App;
• any information, data, photo, or other Content you provide;
• any decision you make, or fail to make, based on or in connection with the App;
• any harm, injury, illness, or death — to your pet, yourself, members of your household, any other person, any other animal, or any property — caused or contributed to by your use of, or reliance on, the App;
• your breach of these Terms or the Privacy Policy;
• your violation of any law or any third party’s rights.

We may, at our option, assume the exclusive defence and control of any matter for which you are required to indemnify us, in which case you agree to cooperate with our defence.

14. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including failures of the internet, mobile networks, infrastructure providers, power, or acts of government, fire, flood, pandemic, civil unrest, or other force majeure.

15. Changes to the App or these Terms

We may change, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time. If a change is material, we will give you reasonable notice in the App or by email. Continuing to use the App after the new Terms take effect means you accept them. If you do not accept them, you must stop using the App.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Singapore, without regard to its conflict-of-laws principles. You and we submit to the exclusive jurisdiction of the courts of Singapore for any dispute arising out of or relating to these Terms or the App, except that we may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual-property rights.

17. General

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the App and supersede any prior agreement on the same subject.
• Severability. If any provision of these Terms is held to be unenforceable, the rest remains in force.
• No waiver. Our failure to enforce any right is not a waiver of that right.
• Assignment. You may not assign these Terms without our prior written consent. We may assign them, for example as part of a corporate transaction.
• No agency. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between us.
• Third-party rights. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any of its terms.
